These Terms and Conditions set out the basis on which Rubbish Removal Westminster provides rubbish removal and waste collection services to customers. By making a booking, confirming a quotation, or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions.

If you do not agree to any part of these Terms and Conditions, you must not use our services.

1. Definitions

In these Terms and Conditions:

1.4 "Site" means the property, premises, or location where the Services are to be carried out.

1.5 "Waste" means the items, materials, or refuse to be collected, removed, transported, or disposed of by the Company as part of the Services.

2. Scope of Services

2.1 We provide rubbish removal and waste collection services for domestic, commercial, and other premises. This may include household waste, garden refuse, office rubbish, bulky items, and general non-hazardous waste.

2.2 The precise scope of the Services for each job, including the volume or weight of Waste to be collected and any special requirements, will be agreed at the time of booking or when our operatives arrive on Site and have viewed the Waste.

2.3 Our Services do not automatically include cleaning, dismantling of structures, or removal of fixtures unless specifically agreed in writing prior to commencement of work.

2.4 We reserve the right to refuse to remove certain items, including but not limited to hazardous or specialist waste, where we are not appropriately licensed or equipped, or where removal would pose a health and safety risk.

3. Booking Process

3.1 Bookings for rubbish removal and waste collection may be made by telephone, email, or online enquiry, where available. A booking is considered an offer by you to purchase Services from us.

3.2 We will confirm acceptance of your booking by verbal confirmation, email, or text message. At the point of confirmation, a contract is formed between you and the Company on these Terms and Conditions.

3.3 At the time of booking, you must provide accurate information about the nature, quantity, and location of the Waste, access conditions at the Site, and any relevant restrictions such as parking, loading, or time limits.

3.4 Quotations provided prior to viewing the Waste are based on the information supplied by you and are indicative only. We may revise the quotation on arrival at the Site if the Waste is significantly different in type, volume, weight, or location from that described at the time of booking.

3.5 We may take photographs of the Waste and the Site before and after the Services for our records, insurance purposes, and to help resolve any disputes. By using our Services, you consent to this, provided that we do not identify any individuals without separate consent.

4. Access and Parking

4.1 You are responsible for ensuring that our operatives have safe, suitable, and lawful access to the Site at the agreed time, including access for our vehicle within reasonable distance of the Waste.

4.2 You must inform us in advance of any restrictions that may affect access or parking, such as controlled zones, height limits, congestion charges, or loading bay time limits.

4.3 Any parking charges, tolls, or similar fees reasonably incurred by us in providing the Services may be added to your invoice and must be paid by you.

4.4 If we are unable to gain access to the Site at the agreed time due to circumstances within your control, we may charge a call-out or wasted journey fee to cover our reasonable costs and lost time.

5. Customer Obligations

5.1 You must ensure that:

(a) you have the full authority to allow access to the Site and to dispose of the Waste;

(b) the Waste is clearly identified and segregated where necessary;

(c) the Waste does not include prohibited, hazardous, or specialist items unless previously agreed;

(d) the Site is safe for our operatives to work and complies with any relevant health and safety requirements.

5.2 You warrant that none of the Waste is contaminated with substances that may cause harm to persons, property, or the environment. If such substances are discovered, we may suspend or terminate the Services and charge you for any additional handling, testing, or disposal costs.

6. Waste Types and Regulations

6.1 We operate in accordance with applicable UK waste management legislation and regulations. We will only collect and transport Waste that we are authorised and licensed to handle.

6.2 Certain waste streams may be refused or subject to extra charges, including but not limited to:

(a) asbestos or materials containing asbestos;

(b) clinical or medical waste, including sharps;

(c) chemicals, solvents, oils, or paints;

(d) gas cylinders, fuel containers, or pressurised vessels;

(e) tyres, large batteries, and electrical items requiring special treatment;

(f) hazardous or toxic substances, or waste subject to special controls.

6.3 We will dispose of or recover Waste at authorised facilities, with the aim of diverting as much as reasonably practicable from landfill, in line with responsible waste collection practices.

6.4 Upon request, and where applicable, we may provide evidence of lawful disposal such as a waste transfer note or similar documentation. Additional administrative charges may apply where detailed reporting is requested.

7. Pricing and Payment

7.1 Prices for our waste collection and rubbish removal services are normally based on a combination of volume, weight, type of Waste, labour time, and access conditions.

7.2 Unless otherwise stated, all prices are quoted exclusive of VAT. Where VAT is applicable, it will be added at the prevailing rate.

7.3 We reserve the right to adjust our prices at any time. However, once a booking is confirmed, the price for that particular job will only change if the information provided at the time of booking is found to be inaccurate or incomplete, or if you request additional services.

7.4 Payment is due as follows, unless agreed otherwise:

(a) for domestic customers, payment is typically due on completion of the job, by cash, card, or other accepted method;

(b) for business or account customers, payment terms may be agreed in writing, subject to credit checks.

7.5 Where credit terms are agreed, invoices must be paid within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

7.6 If you fail to make payment when due, we may charge interest on the overdue amount at the statutory rate, together with any reasonable costs incurred in pursuing the debt.

8. Cancellations and Amendments

8.1 You may cancel or amend a booking by contacting us as soon as possible. Cancellations or changes are not effective until we confirm receipt.

8.2 If you cancel a booking with at least 24 hours notice prior to the agreed arrival time, no cancellation fee will normally be charged.

8.3 If you cancel with less than 24 hours notice, or if our operatives attend the Site and are unable to carry out the Services due to circumstances within your control, we may charge a reasonable cancellation or wasted journey fee to cover our costs.

8.4 We reserve the right to cancel or reschedule the Services in the event of operational issues, vehicle breakdowns, staff shortages, adverse weather, or other circumstances beyond our reasonable control. In such cases, we will notify you as soon as practicable and offer a suitable alternative time.

9. Performance of Services

9.1 We will use reasonable skill and care in providing our rubbish removal and waste collection services and will endeavour to carry out the work within agreed time windows. However, all arrival times are estimates and are not guaranteed.

9.2 Our operatives will assess the Waste and confirm the price before proceeding. If you do not accept the revised price, we will not be obliged to carry out the work and may charge a call-out fee if we have incurred time and costs.

9.3 We will take reasonable care when working at the Site. However, you are responsible for protecting any fixtures, fittings, flooring, or surfaces that may be vulnerable to damage during the removal of bulky or heavy items.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot be lawfully limited or excluded.

10.2 Subject to clause 10.1, we will not be liable for:

(a) any indirect, consequential, or special losses or damages;

(b) loss of profit, business, revenue, or anticipated savings;

(c) loss of or damage to items that you have not clearly identified as Waste and separated from possessions that are not to be removed.

10.3 Our total liability arising out of or in connection with the provision of the Services, whether in contract, tort, or otherwise, shall not exceed the total price paid or payable by you for the specific job to which the claim relates.

10.4 You are responsible for ensuring that any items removed by us are genuinely intended for disposal. We accept no liability for the accidental removal of items that you failed to identify as not being Waste.

10.5 We are not liable for delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to extreme weather, traffic disruption, strikes, or actions of government authorities.

11. Complaints and Disputes

11.1 If you are dissatisfied with any aspect of our rubbish removal or waste collection service, you must notify us as soon as possible and within 48 hours of completion of the job.

11.2 We will investigate complaints promptly and aim to resolve them in a fair and reasonable manner. You agree to provide any evidence or information we reasonably request to help us assess your complaint.

11.3 Where appropriate, we may offer a partial refund, a correction of the Services, or another form of reasonable remedy. Any such remedy will be at our discretion and without admission of liability.

12. Data Protection and Privacy

12.1 We will process any personal data you provide in connection with our Services in accordance with applicable data protection laws.

12.2 Personal information may be used for administering bookings, providing our Services, processing payments, managing accounts, and complying with legal obligations.

12.3 We may retain records of bookings, invoices, and waste documentation for as long as required by law or for legitimate business purposes.

13. Intellectual Property

13.1 Any branding, logos, text, or images produced by or on behalf of the Company remain our intellectual property. You may not use, copy, or reproduce them without our prior written consent.

14. Suspension and Termination

14.1 We may suspend or terminate the provision of Services immediately if:

(a) you fail to pay any amount due on time;

(b) you breach these Terms and Conditions and do not remedy the breach when requested;

(c) we reasonably believe that proceeding would pose a risk to health and safety or involve unlawful activity.

14.2 Termination does not affect any rights or obligations that have accrued prior to termination, including the obligation to pay sums owed.

15. Changes to these Terms and Conditions

15.1 We may amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that booking.

15.2 Updated terms may be made available upon request. It is your responsibility to review the applicable terms before making a booking.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of our rubbish removal and waste collection services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
